Terms of Service

These Terms of Service ("Terms") govern your access to and use of thecreators.pro and any services provided by The Creators ("we", "us", "our"). By engaging our services or using this website, you agree to these Terms.

1. Services

The Creators provides website design, website development, mobile application development, custom software development, SEO, digital marketing, branding and related digital services as agreed in a signed project scope, proposal or invoice.

2. Project Scope & Changes

Each engagement begins with a written scope covering deliverables, timeline and cost. Work outside the agreed scope ("change requests") will be quoted separately and may affect the delivery timeline.

3. Payment Terms

Projects are typically invoiced in milestones (commonly 40% upfront, 30% at midpoint, 30% on completion). Work will not proceed to the next milestone, and final files will not be delivered, until outstanding invoices are settled. Late payments may incur a delay to project timelines.

4. Client Responsibilities

You agree to provide timely feedback, content, and access to accounts or systems required to complete the project. Delays in providing these materials may extend agreed timelines accordingly.

5. Intellectual Property

Upon full payment, ownership of the final deliverables (custom code, design files and content created for you) transfers to the client, excluding any third-party licenses, stock assets, or our proprietary frameworks and internal tools, which remain our property but are licensed for your use within the delivered product.

6. Warranty & Support

We provide a 30-day warranty period after launch to fix bugs directly resulting from our development work. This warranty does not cover issues caused by third-party plugin updates, hosting changes, or modifications made outside our team.

7. Limitation of Liability

To the maximum extent permitted by law, The Creators shall not be liable for any indirect, incidental or consequential damages arising from the use of our services or deliverables. Our total liability for any claim shall not exceed the amount paid for the relevant project.

8. Termination

Either party may terminate an engagement with written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date.

9. Refunds

Refund eligibility is governed by our Refund Policy.

10. Governing Law

These Terms are governed by the laws of India, with disputes subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
